Samuel McCoy, Spanish teacher, faces employment restriction after requesting disability accommodations at Wilcox High School in Santa Clara Unified.

My New Public Statement to the Santa Clara Unified School District Board

(March 13, 2025 at 8pm)

Good evening board members,

 

My name is Samuel McCoy, and I am a Spanish teacher at Wilcox High School.

 

 The SCUSD Board of Trustees, Superintendent, and senior administratorsenabled by the inaction of union leadershiphave fostered a culture of pervasive fear among educators and union representatives, made possible by unchecked administrative authority.  Those responsible for advocating on behalf of educators have not only remained silent, but, at times, actively supported the board's retaliatory decisionswhether to protect their standing with district leadership or for other undisclosed reasons.

 

This is not just a personnel issue; it is a failure of oversight by elected officials entrusted with upholding fairness, transparency, and legal standards within SCUSD.

 

In response to this culture of intimidation, formal complaints have been filed with the California Department of Education (CDE), the California Civil Rights Department (CRD), and the U.S. Department of Education under Title VI for federal civil rights violations. These filings document a systemic pattern of retaliation and discrimination that extends beyond individual cases.

 

On February 14, just 35 minutes after SCUSD received my certified request for tenure confirmation, I was issued a notice of non-rehire. On February 26, SCUSD confirmed in writing that this decision included a permanent restriction on future district employmentretaliation for my legally protected activities, including requesting disability accommodations.

 

On March 10, the board unanimously upheld this decision in a Special Board Meeting scheduled with less than the required 72 hours' notice, in violation of the ADA and district policy, and deliberately timed to overlap with a union meeting. Despite being presented with direct evidence, no board members at the district or county level have responded to my reports of discrimination and retaliation.

 

Your choices send a clear and harmful messagenot only to  our educators but also to students with disabilities and to every community member who expects this district to uphold its stated principles. Your action—or inaction—will define SCUSD leadership's legacy, exposing a profound lack of accountability and integrity.
